What is a Codicil?
We offer codicil drafting as a service at Chatuge Elder Law. Here are some facts and fallacies about codicils:
Fallacy: Editing your will on your own is a good idea.

Crossing out, adding amendments, or otherwise modifying your will with pen or pencil is likely to have the effect of being unrecognized in court at best, or inviting a will contest at worse.

Just as how a will must be properly drafted and witnessed, so too must any changes to your will.

Fact: Many considerations must be taken into account when amending a will.

It is important to have a professional examine the effect that a modification may have on your existing will in order to ensure that no competing directives exists.

For example, if your original will stipulates that a certain automobile be bequeathed to an heir, but in a future amendment you direct that that automobile be bequeathed to a different heir, it is wise to ensure that the earlier directive is properly nullified.
