What is a Guardianship?
We offer guardianship services at Chatuge Elder Law. Here are some facts and fallacies about guardianships:
Fact: A guardianship is a significant responsibility.

As a guardian, you will be responsible, among other things, for:

Acting in the wards best interest.

Protecting, maintaining, and educating the ward.

Acting above suspicion to ensure ward receives proper judgement.

Presenting undivided loyalty to the ward.

Failure to do so can result in significant consequences.
Fallacy: A guardianship may be appointed on the basis of ill-advised behavior.

The court only considers whether an individual lacks the sufficient capacity to make decisions for themselves, not whether the individual has displayed poor judgement in the decisions they have made.
Fact: Guardianships can be expensive.

The process of applying for a guardianship can cause expense at many stages. With court fees, attorney fees, and even bonding and supervision fees (once appointed), being appointed as guardian could cost you.
