What is Medicaid Planning?

We offer Medicaid planning as a service at Chatuge Elder Law. Here are some facts and fallacies about Medicaid planning:

Fact: Medicaid eligibility is complicated. 

  • Medicaid regulations vary state by state and understanding these regulations is key in avoiding lengthy reapplication penalties.

  • When possible, you should consult an experienced Medicaid attorney to help you understand what the requirements are for eligibility. 

Fallacy: Medicaid is free. 

  • While you do not have to pay to receive the benefits of Medicaid while you are living, the state which you received Medicaid assistance from has the right to put a lien on your estate in order to recollect the cost of medical services provided. 

Fallacy: If your income exceeds the Medicaid requirements, then you do not qualify. 

  • You can still qualify for Medicaid if your income is over the current monthly maximum via the drafting of a Qualified Income Trust (this is known as a Miller Trust). 

  • If a will was created under duress by an external party, then it may be found invalid. 

Fact: A good Medicaid Plan can save you and your family money. 

  • Medicaid can provide you with security of guaranteed care, but with proper planning, you can avoid costly penalties and expensive mistakes that one might incur navigating through Medicaid on their own.
