What is a Will?
We offer will drafting as a service at Chatuge Elder Law. Here are some facts and fallacies about wills:
Fact: A will can be revisited.
-
Your will can be revisited or even completely revoked at any time!
-
Your will may even change depending on life events such as a divorce, a new child being born, and even a marriage!
Fallacy: A will is capable of dispersing all of your assets.
-
A will is only capable of dispersing your "probate assets", or the "assets" registered solely in your name.
-
If any competing title instruction exists, it follows that instruction instead of your will.
Fact: A will can be found to be invalid.
-
If a will signing was not witnessed and signed by two competent adults, then it may be found invalid.
-
If a will was created under duress by an external party, then it may be found invalid.
Fact: A will can save your estate money.
-
A properly drafted will can save your estate money by:
-
Waive the necessity of a bond by your executor.
