What is a Will?

We offer will drafting as a service at Chatuge Elder Law. Here are some facts and fallacies about wills: 

Fact: A will can be revisited.

  • Your will can be revisited or even completely revoked at any time!

  • Your will may even change depending on life events such as a divorce, a new child being born, and even a marriage!

Fallacy: A will is capable of dispersing all of your assets.

  • A will is only capable of dispersing your "probate assets", or the "assets" registered solely in your name. 

  • If any competing title instruction exists, it follows that instruction instead of your will. 

Fact: A will can be found to be invalid.

  • If a will signing was not witnessed and signed by two competent adults, then it may be found invalid. 

  • If a will was created under duress by an external party, then it may be found invalid. 

Fact: A will can save your estate money. 

  • A properly drafted will can save your estate money by:

    • Waive the necessity of a bond by your executor.

    • Waive the necessity of court-supervised reporting (GA only).
